Terms of Service

Effective Date: May 31, 2026  •  Last updated: May 31, 2026

Plain-English Summary: By using this website, you agree to use it lawfully and provide accurate information. Our content is informational — nothing here is a guaranteed contract unless we confirm it in writing. We own the creative content on this site. These terms may change, and we’ll update this page when they do.

1. Agreement to These Terms

By accessing or using the website at alcarte.ca (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

These Terms apply to all visitors, customers, and others who access or use the Site. The Site is operated by À La Carte by Josée (“we,” “us,” or “our”).

2. Acceptable Use

You agree to use this Site only for lawful purposes. You must not:

  • × Use the Site in any way that violates applicable local, provincial, national, or international law or regulation.
  • × Transmit unsolicited commercial messages (spam) or attempt to interfere with the Site's operation.
  • × Attempt to gain unauthorized access to any part of the Site or its infrastructure.
  • × Use automated tools, bots, or scrapers to access or collect data from the Site without our written consent.
  • × Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

3. Accuracy of Information Submitted

When you submit information through any form on this Site — including contact forms, custom order requests, or checkout — you represent that the information you provide is accurate, complete, and current. Providing false or misleading information may result in cancellation of your order or request without notice or refund.

4. Website Content Is Informational

All content on this Site — including product descriptions, pricing, availability, and images — is provided for general informational purposes and is subject to change without notice.

Nothing on this Site constitutes a binding offer or contract unless explicitly confirmed in a separate written communication from us (such as an order confirmation email). Submitting a custom order request or placing an item in your cart does not guarantee product availability, pricing, or acceptance of your order.

We reserve the right to cancel or modify any order if pricing or availability information on the Site was incorrect, if a product is no longer available, or for any other reasonable business reason. In such cases, we will notify you promptly and issue a full refund if payment was collected.

5. Orders, Payment & Returns

Orders are subject to acceptance and availability. We reserve the right to refuse service to anyone for any lawful reason. Payment is processed through Stripe, a third-party payment processor. By completing a purchase, you agree to Stripe’s Terms of Service.

Because our products are handmade and often custom or personalized, we may not be able to accept returns in all cases. Please contact us if you have an issue with your order — we want you to be happy with your purchase and will work with you to resolve it.

6. Intellectual Property

All content on this Site — including but not limited to text, photographs, graphics, logos, and product designs — is the property of À La Carte by Josée or is used with permission, and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on this Site without our prior written permission. Personal, non-commercial sharing of links to this Site is permitted.

7. Third-Party Services

This Site uses third-party services including Stripe (payment processing) and Cloudflare (hosting, security, and bot protection). These services are governed by their own terms of service and privacy policies. We are not responsible for the practices of these third parties.

Links to third-party websites may appear on this Site. We do not endorse and are not responsible for the content or privacy practices of any linked external sites.

8. Disclaimer of Warranties

This Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, completeness, or suitability of any information on the Site.

9. Limitation of Liability

To the fullest extent permitted by applicable law, À La Carte by Josée, its owner, and any associated parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site, inability to access the Site, or any products or services purchased through the Site.

In no event shall our total liability to you for any claim arising from your use of this Site or any purchase exceed the amount you paid for the specific product or service at issue.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
